TellAbout offers photo and story albums for important moments and stories. TellAbout albums are designed for collecting, preserving, and viewing moments, memories and stories together with the other members. Albums can be downloaded as digital books and also get printed as books.
In order to use TellAbout you need to be at least 13 years old. Persons who are under 18-years old can only use the Service with their parent’s or guardian’s permission. Hobby clubs and similar associations can use the Service without business purpose according to these Terms. For business use or for reselling the Service, please contact TellAbout and we will help you. We also serve our customers for additional services like extending the number of albums, the size of albums or getting other customizations.
1.2 Registration and Getting Started
The agreement to use the Service in accordance with these terms and conditions becomes effective when you register as a user for the Service (the “User”), or when you first time log in to TellAbout. If you do not agree with these Terms, you may not use TellAbout Service.
During registration process a user account is created for the User. TellAbout serves as a personal digital bookshelf for albums. This bookshelf holds the TellAbout albums you create and own. It will also provide access to albums you have joined as a member by personal invitation (album is owned by someone else).
Create a new album to start and invite others to join the album. Users with whom you share an album can participate: create memories and stories, as well as comment and share photos, audio and videos (media files) in the album. These are shared to all those users who are members of the album.
The album content can be also generated into digital books (eBooks) of PDF format and into hardcovers. TellAbout albums provide flexibility for preserving, viewing and updating your albums.
Only the album owner or co-owner can remove any content at the album. Other album members can only delete content created by them. Album owner has the right to delete an album from the Service.
1.3 Prices, payment, and cancellation
Registering for the service, BASIC albums, and participation to all albums owned by others is free-of-charge. Some TellAbout services are provided to you free-of-charge and they are referred as ”BASIC” and ”BASIC subscription”. Other TellAbout services require payment before you can access them, and they are currently referred as ”PRIME” and ”PRIME subscription” or ”paid subscriptions”.
PRIME subscriptions have been priced according to the current price list available at the Service. You can see the pricing details from our web site pricing pagepricing page. The Service Provider may change the prices from time to time and informs subscribers about the change to the email address they have provided accordingly. The price change will take effect from the beginning of the next subscription payment period.
System can contain fixed-period and continuous paid subscriptions. Continuous paid subscriptions are automatically renewed at the end of the subscription period, unless the subscription is cancelled before the next subscription period begins.
The user can choose to cancel paid subscription at any time from subscription management (“BUY & UPGRADE”). Cancellation is recorded immediately (end day becomes visible at the album subscription status) and subscription becomes inactive the following day after the last day of the current paid subscription period. This means paid services is available until the end of the paid subscription period.
When PRIME subscription ends or a trial period ends, and no valid PRIME subscription is placed, the albums you own are available, but under the limitations of a BASIC subscription. If you want to continue using them as PRIME albums, upgrade your account back to PRIME.
Subscription fees are not returned. Unless the Subscription description in the Service or these Terms explicitly state otherwise, the paid Subscriptions of the Service are services mentioned in Directive on Consumer Rights 2011/83/EC and Consumer Protection Act (38 /1978), Chapter 6, Section 16, where electronic delivery has been started with consumer’s consent before the withdrawal period mentioned in Consumer Protection Act, Chapter 6, Section 15, has expired. Therefore there is no right to withdraw.
A print product such as printed books ordered through the facilities of the Service is personalized for User according to User requests in a manner described in Consumer Protection Act Chapter 6, section 16 and cannot be returned to be resold. Therefore there is no withdrawal right for such products.
Sales, payment and payment processing is provided by FastSpring, a global specialist on safe e-commerce.
1.4 The User’s Rights and Responsibilities
The User must provide valid email address for the Service Provider and keep it up-to-date (in the user account information) so that Service Provider can inform User about the possible changes related to the User’s account.
The user password is personal. Your user password protects your user account and you are solely responsible for keeping your password confidential and secure. If your username or password is lost or stolen, or if you believe there has been unauthorized access to your account by third parties, please notify TellAbout support immediately and change your password immediately. Service Provider shall not be liable for any direct or indirect harm resulting from the unauthorized use of your user account.
The user is responsible for all use of his/her username and password on the Service, as well as the material that you upload or create on the Service, whatever the nature of the form or manner in which the material has been published, as well as the use of the material, which User prints or saves from the service. User is solely responsible for the use and legality of such material.
The user has the right to use the Service according to laws, other regulations, good manners these Terms. You may use the Services for your personal use. TellAbout respects intellectual property rights and expects you to do the same.
User retains his/her existing property rights, as well as all intellectual property rights for the material created on the Service or uploaded to the Service. Content that User obtains on the Service from third parties such as other users is given for User’s personal use only. You agree not to disseminate or exploit such content without the express written permission from the person who owns the rights to such content.
User may not upload, create or introduce illegal or criminal content on the Service. User may not attempt to hack or break the system in any way. User may not use scripts or other automated processes to manipulate the service. Service may not be used to send spam, direct marketing or similar. Service may not be used for business without a comprehensive service agreement with the service provider. The user is not authorized to use the information contained in the Service to a development, production or marketing of a similar Service. The User is required to fully compensate for the damages caused by the unlawful conduct or neglect of these Terms.
As in other web and mobile services, User is responsible for their own costs related to the use to the Service such as compatible devices, communication links and their maintenance.
1.5 Service Provider’s Rights and Responsibilities
Service Provider does not have any rights or license to use, reproduce, adapt, modify, publish, upload, store or distribute the content User creates or uploads to the Service other than to the extent that it is necessary for the production, development and maintaining of the Service.
The service provider does not use the content of the albums for advertising or promotional purposes.
The Service itself is protected by trademark, copyright and other intellectual property rights. Ownership rights to copyright, trademark and all other legal protection, applications, as well as all the trade secrets and know-how (together referred to as “Intellectual Property”) will remain under the sole ownership the Service Provider or a third party. Models, designs or templates that originate from the Service and that are used by User to organize his/her material with the tools and features of the Service, are not owned by the User. User acknowledges and accepts that User has no rights beside the right to use to such models, designs, templates or tools, and that they remain in the sole property of the Service Provider.
The User uploads and creates material to the Service and the responsibility for this content of the material is by User. The Service Provider is not responsible in any way of the material sent or imported to the Service, or content created on the Service, such as media files or the contents of the texts written by the User or other users. The Service Provider is not responsible for the content or information User obtains from third parties via Service.
Service Provider does not monitor or otherwise control the private content in the Service. The size of the media files uploaded to Service may be limited. The Service Provider has at any time at its own discretion the right, but not the obligation, to remove reportedly inappropriate material. The Service Provider has the right to disclose illegal material or material that is in breach of these Terms to a legitimate competent authority. The Service Provider has the right to remove from the Service a User who has given false user information or otherwise broken these Terms, the law or good manners and prevent his/her from access to Service. The service provider can change User’s password if the Service Provider suspects that the User’s password is no longer in reliable hands or is being misused.
Service is provided to the user as it is. The Service and its product range continues to grow. We develop and improve the service based on the received feedback and user cooperation. The Service has free, unlimited and permanent right to utilize suggestions or feedback given by Users to the Service Provider.
The Service Provider tries to ensure the smooth operation of the service. The Service Provider is not responsible for temporary outages and any resulting direct or indirect damages caused by technical failures, telecommunications failures, malicious software, shortcomings, errors, maintenance or installation. Service provider is liable to pay compensation only for direct damage demonstrated by User that was caused by Service Provider’s intentional negligent act or omission in breach of these Terms. Service provider’s liability for damages in all cases limited to the amount User paid for the use of the service in the last twelve months. The service provider does not under any circumstances compensate for indirect damage or damage due to force majeure
The User, or the Service Provider, can terminate the Service contract at any time with a notice to the other party. The User can make the termination notice by deleting the User account from within TellAbout application and termination becomes effective immediately when user sees confirmation notification. If the User owns any albums, they must be deleted before the User account can be deleted. The amounts that you have already paid for the Service will not be refunded.
BASIC accounts that are considered abandoned may be terminated by Service Provider. BASIC accounts without activity and without albums visited by any album members for 12 months, may be suggested for removal. User and the album members will be informed about the removal suggestion to the email address they have given to the Service provider in the TellAbout user information section. Account may be removed after a grace period of 2 months, if the User does not respond. When the grace period has passed, account may be deemed as abandoned and may be deleted if the Service Provider so chooses. This will not have any affect to the digital books that you may have downloaded from the TellAbout to yourself as PDF-files.
1.7 User data and privacy
The user’s contact information will not be used for digital direct marketing purposes without the user ‘s consent, if the applicable law so requires. The customer always has the right to prohibit the marketing communications by a notice to the Service Provider.
1.8 Links to third party websites
The Service may contain links to Third-Party owned or managed websites. The Service Provider is not responsible or liable for any transactions between user and third-party providers of Third-Party Applications or products. The Service Provider recommends reading carefully each of the Website and privacy terms.
1.9 The Level of Service
The Service Provider has the right to modify the Service and make changes to contents of the service, technology, appearance and use of the Services without prior notice. Service provider will endeavor best ways to ensure to function of services and to correct any errors in the Service within a reasonable period of time. The Service Provider has the authority to temporary close the Service or part of it, if it is necessary for a justified reason. In this case, the Service Provider aims to act in such a way that the interruption is as short as possible, as to cause the least possible inconvenience to the User.
1.10 Entire Agreement
These Terms constitute the entire agreement between the User and the Service Provider and supersede all prior or contemporaneous communications and proposals, (whether oral, written or electronic) between User and the Service Provider.
1.11 Territorial Restrictions
Use of the service is only allowed in EU countries.
1.12 Governing Law and Jurisdiction
These Terms shall be governed by Finnish law. Except where prohibited by applicable law, any disputes will be settled in the Helsinki District Court.
1.13 Force Majeure
Strike, natural disaster, fire, governmental action, or other force majeure (force majeure) releases the service provider to comply with these Terms for the time of the force majeure event.
The Service Provider has the right to change the Terms. Updated and current Terms are available on TellAbout User account/Basic information section and/or knowledge of the user account information will be mailed to the User account e-mail address. The changes take effect immediately. If the user continues to use the Service after changes to the Terms, User shall be deemed to have accepted the changed Terms.
